Terms and Conditions of Sale (T&CS)

Article 1 – Definitions

These General Terms and Conditions of Sale (hereinafter the "T&CS") are offered by the company GESTION CHEF PAUL TOUSSAINT INC, under business number 788071504, with its registered office at 2025 rue d'Auvergne, Laval (QC), H7G 2G8, Canada (hereinafter "IMAGINE LA MAISON").

Hereinafter, we will refer to:

  • "Site": the website https://imaginelamaison.com and all its pages, exclusively owned by the Company.
  • "Products" or "Services": all products and services that can be purchased or subscribed to on the Site.
  • "Seller": IMAGINE LA MAISON, offering its Products or Services on the Site.
  • "Client": the internet user, individual or professional, making a purchase of Product(s) or Service(s) on the Site.
  • "Consumer": in accordance with the definition in the preliminary article of the Consumer Code, any natural person who acts for purposes that are outside their commercial, industrial, craft, or liberal activity.

Internet users visiting the Site are invited to read these T&CS carefully, print them, and/or save them on a durable medium before placing an order. The Client acknowledges having read the T&CS and accepts them in full.

Article 2 – Application of T&CS and Purpose of the Site

The Seller reserves the right to modify the T&CS at any time by publishing a new version on the Site. The T&CS applicable to the Client are those in force on the day of their order.

Legal information regarding the host, the publisher of the Site, the collection and processing of personal data, and the terms of use of the Site are provided in the legal notices and privacy policy of this Site.

This Site offers the online sale of home and interior decoration products, including bed linen, lighting, furniture, and storage accessories. This offer is subject to regular changes.

The Site is freely accessible to any Client. The acquisition of a Product implies the Client's acceptance of all of these T&CS. This acceptance is materialized by checking the acceptance box during the ordering process, which has the same value as a handwritten signature.

Acceptance of these T&CS implies that Clients have the necessary legal capacity. If the Client is a minor, they declare that they have the authorization of a guardian, curator, or their legal representative.

The Client must indicate their first name, last name, the subject of their request, and their Order number in their request. For any professional request (partnership, media, contract proposal), the Company can only be reached by email at contact@imaginelamaison.com.

Article 4 – Order Placement Procedures and Purchase Process Description

The Products offered are those listed in the catalog published on the Site. Each product is accompanied by a description prepared by the Seller based on descriptions provided by the supplier. The photos on the Site are non-contractual and may vary slightly from the photographed models due to screen display settings, lighting, or shooting angle.

To place an Order, the Client:

  • Selects the desired Product(s) by adding them to their "Cart"
  • Checks the details of their Order on the "Cart" page and can correct any errors
  • Enters their contact information on the "Information" page
  • Chooses their shipping method on the "Shipping" page
  • Enters their banking details and billing address on the "Confirmation" page
  • Validates their Order by clicking on "Finalize my order"

The sale is validly formed when the Client has confirmed the Order, accepted the T&CS, and made the payment. The Client is responsible for errors related to their Order and contact information.

Article 5 – Price and Payment Terms

Unless otherwise stated, the prices listed in the catalog are expressed in Euros, all taxes included (TTC), excluding any processing and shipping fees. IMAGINE LA MAISON reserves the right to modify its prices at any time. Nevertheless, the price listed in the catalog on the day of the order will be the only one applicable to the Client.

The Client can make their payment by Credit Card, Apple Pay, or PayPal. Credit card payments are made via secure transactions provided by an online payment service provider. This Site does not have access to any data relating to the Client's payment methods.

IMAGINE LA MAISON will archive purchase orders and invoices on a reliable and durable medium. The computerized records will be considered by the parties as proof of communications, orders, payments, and transactions between the parties.

Article 6 – Deliveries

Delivery costs will be indicated to the Client before any payment. The Site has no geographical delivery limitations. The delivery times indicated during the order are provided for informational purposes only and depend on any delays by postal services or other specific circumstances (demonstrations, bad weather, etc.).

Unless otherwise stated, the Seller undertakes to deliver the Products within a maximum of thirty (30) days after the conclusion of the contract with a Consumer Client. Any delay exceeding this period may result in the cancellation of the sale at the initiative of the Consumer Client, upon written request, after having enjoined the Seller to make the delivery. The Client will then be refunded within fourteen (14) days following the cancellation of the contract.

In case of hand delivery, the Client may refuse a package showing an anomaly (damage, missing product, damaged package). Any anomaly must be indicated on the delivery note, in the form of handwritten reservations signed by the Client. In case of mailbox delivery, the Client undertakes to immediately check the package and contact IMAGINE LA MAISON support in case of anomaly.

In case of a return of the package to the Seller, the Seller will contact the Client to agree on the follow-up to the order. If the Client refused the package by mistake, they may request its reshipment by paying the corresponding postal fees.

In case of delivery outside the European Union, the Client declares themselves the importer of the Product and accepts that customs duties or import taxes may apply, the exact amount of which cannot be guaranteed by the Seller.

Article 7 – Right of Withdrawal

In accordance with Article L.221-18 of the Consumer Code, the Consumer Client has fourteen (14) calendar days from the date of receipt of the Product to exercise their right of withdrawal, without having to justify their reasons or pay penalties, with the exception of return costs which remain at their expense.

The Product must be returned in perfect, unused condition and in its original packaging within fourteen (14) days following the notification of withdrawal. It is recommended to make the return by a method that allows tracking of the package.

The refund will be made within fourteen (14) days following the receipt of the returned Product, using the same payment method as chosen for the initial transaction. The Seller reserves the right to defer the refund until receipt of the Product or until the Client has provided proof of shipment.

In case of depreciation of the Products resulting from handling other than what is necessary to establish their nature and characteristics, the Client's liability may be engaged.

Article 8 – Product Warranty

All items purchased on this Site benefit from the following legal guarantees, provided for by the Civil Code and the Consumer Code:

Legal guarantee of conformity (2 years)

In accordance with articles L.217-4 and following of the Consumer Code, the Seller is required to deliver goods that conform to the contract and is liable for any conformity defects existing at the time of delivery. In case of a lack of conformity, the Client chooses between repair and replacement of the goods. If this choice entails a cost that is clearly disproportionate, the Seller may proceed according to the modality not chosen by the Client. This guarantee applies for a period of two (2) years from the delivery of the Product.

Legal guarantee against hidden defects

In accordance with articles 1641 and following of the Civil Code, the Client may implement the guarantee against hidden defects of the item sold. In this case, the Client has the choice between cancellation of the sale or a reduction in the sale price, in accordance with article 1644 of the Civil Code. They have a period of two (2) years from the discovery of the defect.

In case of non-conformity of a delivered Product, the return and replacement costs are borne by the Seller. In case of impossibility of exchange (obsolete Product, out of stock), the Client will be refunded the amount of their order.

Article 9 – Liability

The Seller IMAGINE LA MAISON cannot be held responsible for the non-execution of the contract due to the occurrence of a force majeure event. The choice and purchase of a Product are the Client's responsibility.

In any event, IMAGINE LA MAISON cannot under any circumstances be held responsible for any direct or indirect damage resulting from the use of the Site, a malfunction, or misuse of the Products, except in cases of proven hidden defect, non-conformity, or exercise of the right of withdrawal provided by law.

The Seller's liability cannot be engaged if the characteristics of the Products differ slightly from the visuals on the Site due to screen display settings.

Article 10 – Force Majeure

In accordance with Article 1218 of the Civil Code, events beyond the control of the parties, which they could not reasonably foresee or avoid, making the fulfillment of obligations totally impossible, are considered force majeure.

The occurrence of a force majeure event will automatically suspend the execution of the Order. Beyond a period of ninety (90) calendar days, if the parties confirm the persistence of the force majeure event, the Order may be canceled by either party by registered letter with acknowledgment of receipt. In this event, neither party may claim damages, unless otherwise agreed.

Article 11 – Intellectual Property Rights

All elements of this Site belong to the Seller or are used with the authorization of their owners. All texts, comments, illustrations, and images reproduced on the Site are protected by copyright, trademark law, and patent law.

Any reproduction, exploitation, redistribution, or use, even partial, of the elements of the Site is strictly prohibited without the prior written agreement of GESTION CHEF PAUL TOUSSAINT INC. Any hypertext link to the Site is prohibited without the express written authorization of the Company. Any offender is subject to the penalties provided for in articles L.335-2 and following of the Intellectual Property Code.

Article 12 – Processing of Personal Data

The Company collects Client data for the purpose of:

  • Processing and tracking the Client's Order
  • Managing customer relationships and communicating about Product developments
  • Improving the Site and Products (especially through cookies)

The collected data is processed by the Site's contractual service providers in charge of distributing the ordered Products, as well as by Shopify Inc., the Site's host, whose servers are secured. Data is stored for a maximum period of five (5) years.

In accordance with Regulation (EU) 2016/679 (GDPR) and Law No. 2018-493 of June 20, 2018, the Client has the right to access, modify, rectify, delete, and oppose their data. These rights can be exercised by email at contact@imaginelamaison.com.

Article 13 – User Comments and Suggestions

If the Client sends ideas, suggestions, or other items to the Company, they grant the Company the right to edit, copy, publish, distribute, translate, and use these comments in any media, without restriction of time or support.

The Company is not obliged to maintain the confidentiality of comments, pay compensation to their author, or respond to these comments. It may delete any content it deems illegal, offensive, or contrary to these T&CS.

The Client undertakes to publish only comments that comply with the law, do not violate third-party rights, and are free of any malicious content. They are entirely responsible for the comments published.

Article 14 – Severability of Clauses

If any provision of the T&CS is deemed illegal, void, or unenforceable, that provision will be deemed severable from the T&CS and will not affect the validity of the remaining provisions. These T&CS supersede all prior written or oral agreements. Any correspondence relating to the T&CS must be written in French.

Article 15 – Applicable Law and Mediation

These General Terms and Conditions of Sale are subject to French law.

Rights of consumers residing in the European Union: in accordance with applicable European law, consumers residing in the European Union retain the benefit of the protective provisions of their national law and may refer to the courts of their country of residence.

In case of a dispute, the Consumer Client may resort to consumer mediation free of charge. The European Commission provides an online dispute resolution platform accessible at the following address: https://ec.europa.eu/consumers/odr/

To resort to mediation, the Client must first have attempted to resolve their dispute directly with IMAGINE LA MAISON by written complaint to contact@imaginelamaison.com. Mediation is free for the Client. Participation in mediation does not exclude the possibility of recourse before a competent court.

The Site reserves the right to initiate criminal proceedings against any attempt at fraudulent purchase or purchase made with a stolen, falsified, or opposed credit card.

Article 16 – SMS Policy

By agreeing to receive SMS communications from IMAGINE LA MAISON during the order process or via our subscription tools, you agree to receive messages related to your order (confirmations, delivery updates, reminders), as well as marketing and promotional communications.

Message frequency may vary. Consent to receive SMS is not a condition of purchase.

Unsubscribe: To stop receiving messages, reply STOP to any message received or use the unsubscribe link provided. Any other method will not be considered a valid unsubscribe.

Sending and receiving SMS messages may incur charges depending on your phone carrier. IMAGINE LA MAISON does not charge for this service.
