Article 1 — Purpose and Acceptance
These Terms of Use (the “Terms”) govern access to and use of the website https://imaginelamaison.com (the “Website”), operated by the seller identified in the Legal Notice (the “Seller”).
By browsing the Website, users agree to these Terms. The Terms may be amended at any time; the version applicable is the one published on the Website on the date of access. Users are encouraged to review them regularly.
The terms governing purchases—including orders, prices, delivery, withdrawal rights, warranties and mediation—are set out in the Terms and Conditions of Sale, which prevail over these Terms in all matters relating to sales.
Article 2 — Access to the Website
The Website is available free of charge to any user with internet access. Any costs associated with such access, including connection and equipment costs, remain the user’s responsibility. The Seller endeavours to keep the Website available at all times but is under no obligation to do so. Access may be interrupted without prior notice for maintenance, updates or other reasons, including technical reasons. The Seller does not warrant that the Website will operate continuously or be free from errors.
Article 3 — Customer Accounts
When creating a customer account, users must provide accurate, complete and up-to-date information. Users are responsible for keeping their login credentials confidential and for all activity conducted through their account. Any unauthorized use must be reported immediately to customer service at contact@imaginelamaison.com.
After notifying the user, the Seller may suspend or delete any account used in breach of these Terms, the Terms and Conditions of Sale or applicable law, including in cases of fraud, identity theft or conduct compromising the security of the Website. This is without prejudice to the user’s rights arising from orders already concluded or from mandatory consumer-protection provisions.
Article 4 — Use of the Website and User Content
Users agree to use the Website only for its intended purposes, including browsing the catalogue, making purchases and submitting reviews. Users must not compromise the Website’s security or integrity, introduce malicious software or collect other users’ data.
Content published by users, including reviews and comments, is governed by Article 13 of the Terms and Conditions of Sale concerning the status, licensing and moderation of reviews. Those provisions also apply to content submitted independently of a purchase.
Article 5 — Intellectual Property
The Website’s elements—including its text, visual content, logos, structure and databases—are protected as described in Article 11 of the Terms and Conditions of Sale. No use other than private consultation is permitted without the Seller’s prior written consent, subject to the exceptions provided for in Article L. 122-5 of the French Intellectual Property Code.
Article 6 — Hyperlinks
The Website may contain links to third-party websites whose content and practices are not controlled by the Seller. Users access such websites at their own responsibility. A simple link to the Website’s home page may be created provided that it does not cause confusion as to the source of the content. Any reproduction of content remains subject to Article 5.
Article 7 — Liability
The Seller endeavours to provide accurate and up-to-date information on the Website but cannot guarantee that it is free from omissions or inaccuracies, particularly where information is supplied by third parties such as suppliers or manufacturers. Any error may be reported to contact@imaginelamaison.com.
This limitation does not affect any statutory warranty applicable to products purchased, including the legal guarantee of conformity and the warranty against hidden defects, the right of withdrawal, or any other mandatory provision of French consumer law. Those rights remain governed by the Terms and Conditions of Sale and applicable law.
Article 8 — Personal Data and Cookies
The processing of users’ personal data is described in the Privacy Policy. The use of cookies and tracking technologies is addressed in Section 7 of the Privacy Policy. That policy is the authoritative document on these matters.
Article 9 — Governing Law
These Terms are governed by French law, subject to the conditions and reservations set out in Article 15 of the Terms and Conditions of Sale, including the mandatory protections afforded by the law of the consumer’s country of residence, rules of jurisdiction and consumer mediation. The French-language version is the authoritative version.
